Life Insurers Prohibited from Using Genetic Tests to Deny Coverage or Increase Premiums

Following the recommendations of a report led by Monash University’s Dr. Jane Tiller and Professor Paul Lacaze, the Australian Government announced on September 10, 2024, its plan to legislate a complete ban on the use of genetic test results in life insurance underwriting. This groundbreaking legislation ensures that Australians will no longer be subjected to financial limits, caps, or exceptions imposed by life insurers based on genetic testing results.
 
 
Dr. Tiller, a previous guest speaker at our Community Conference and the lead author of the Monash report, emphasised the significance of this move: “Our research has shown that the fear of insurance discrimination deters people from having genetic testing that could save their lives or from participating in important genetic research. Today’s announcement marks a decisive step by the Government to ensure Australians can make genetic testing decisions based on health needs, not financial implications”.

The Australian Government has positioned Australia as one of the global leaders by banning life insurers from using adverse genetic test results in their underwriting processes. This decision is a result of years of advocacy from community groups, including those impacted by Huntington’s disease, who have campaigned tirelessly for this change. This decision was shaped through extensive consultation and stakeholder engagement, ensures that all Australians can fully benefit from genetic testing without worrying about financial repercussions. Importantly, individuals can still choose to disclose favorable test results if they wish, but not be forced into doing so.

There were over 1000 submissions received during consultations on how to address genetic discrimination in life insurance, with 97% supporting a total ban. This ban will be reviewed every five years to safeguard against any unintended consequences.

No Australian should hesitate to undergo testing out of fear it could affect their ability to obtain life insurance. It’s a crucial step forward in ensuring that every Australian, especially those affected by Huntington’s disease, can access genetic testing without fear of discrimination.
